These Terms of Service ("ToS") govern the use of ScreenVox's services, provided by Boundless Friends Corp., a Delaware corporation (d/b/a ScreenVox). The following definitions apply:
By using ScreenVox's services, users confirm that they have read, understood, and accepted these ToS. Users must be at least 18 years of age or, if under 18, have the consent and supervision of a parent or guardian. Users under 13 may only use the services through a parent or guardian's account. If you do not agree to these ToS, you must discontinue your use of ScreenVox immediately. ScreenVox reserves the right to modify these terms at any time without prior notice. Continued use of the service signifies acceptance of any updates.
To access ScreenVox's services, users must create an account by providing accurate, current, and complete information, including a full name, valid email address, and secure password. Users agree to maintain the confidentiality of their account credentials and accept responsibility for all activities that occur under their account. Unauthorized access must be reported immediately to ScreenVox. Each user is limited to one account. While our service infrastructure is based in the U.S., we welcome users from other regions provided that use of the service is lawful in your jurisdiction.
Users agree to use ScreenVox's services responsibly and in compliance with applicable laws. By uploading or submitting any content, you represent and warrant that you are the owner of the content or have obtained all necessary rights and licenses to use, modify, and submit the content to ScreenVox. You agree not to upload any content that infringes another's copyright, trademark, or other rights. The following activities are strictly prohibited:
Accounts created on behalf of children under 13 must be supervised by a parent or guardian in compliance with COPPA.
Parental Acknowledgment and Consent: Parents and guardians acknowledge and accept all risks associated with their minor children's use of ScreenVox's services, including any content generated or processed by the AI. ScreenVox is not liable for any consequences arising from a minor's use of the service under parental supervision.
ScreenVox retains all rights, title, and interest in its services, software, trademarks, and related intellectual property. Users are granted a limited, non-exclusive, non-transferable license to use the services for personal, non-commercial purposes only. Users are prohibited from copying, reproducing, modifying, or creating derivative works based on ScreenVox's services or intellectual property without explicit permission.
Users retain ownership of any screenplay content they submit through the ScreenVox services. Users also retain all rights and ownership to the content they create or generate through the Services, including audio outputs and any visual materials produced. ScreenVox does not claim any intellectual property rights over such outputs. By submitting content, users grant ScreenVox a limited license to use, store, and process this content solely for purposes related to the functioning, maintenance, and improvement of the services. ScreenVox's rights to user content are limited to operating the service and do not transfer ownership of either the input or output to ScreenVox. Data handling practices are detailed in the Privacy Policy, accessible on our website.
ScreenVox services require payment as outlined below:
No Refund Policy: All payments made to ScreenVox, including subscription fees and processing fees, are non-refundable under all circumstances. Users agree that no refunds, credits, or reversals will be provided for processed payments.
ScreenVox reserves the right to suspend or terminate accounts for non-payment, violations of the ToS, or activities that may harm ScreenVox or its users. Upon termination, ScreenVox may delete user data, and the user agrees to waive any claims against ScreenVox for loss of data.
Disclaimer of Warranties: ScreenVox's services, including but not limited to software, applications, and related services, are provided on an "as is," "as available," and "with all faults" basis. ScreenVox expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:
No oral or written information or advice provided by ScreenVox or its representatives shall create any warranty.
Third-Party Service Limitation: ScreenVox's services rely on integration with third-party services, including OpenAI and ElevenLabs. ScreenVox cannot guarantee the continued availability, functionality, or performance of these third-party APIs, and disclaims liability for any disruptions, limitations, or issues arising from third-party services.
Limitation of Liability: To the fullest extent permitted by law, ScreenVox and its officers, directors, employees, agents, licensors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses arising from or related to:
In no event shall ScreenVox's total cumulative liability for all claims related to the services exceed the amount paid by the user in the twelve (12) months preceding the event giving rise to the liability, or $100 USD, whichever is less.
Users agree to indemnify, defend, and hold harmless ScreenVox (Boundless Friends Corp.) and its officers, directors, employees, agents, licensors, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from or related to:
Users agree to cooperate fully with ScreenVox in the defense of any claim that is subject to their indemnification obligations. ScreenVox reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification.
These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflicts of law provisions. All disputes arising from or relating to these Terms or the services provided by ScreenVox shall be resolved through binding arbitration conducted in Austin, Texas, under the rules of the American Arbitration Association (AAA). Users waive their right to bring claims in a court of law and agree to arbitration on an individual basis only, not as a class or representative action.
Class Action Waiver: Users agree to resolve disputes on an individual basis only, and waive the right to participate in any class, collective, or representative action, including in arbitration or otherwise.
Consumer Protection: These terms apply except where otherwise prohibited by applicable law. If you are a consumer residing in the European Union, you may have certain rights by law that override some of the above terms, and you retain the right to bring certain disputes in the courts of your home country.
ScreenVox respects intellectual property rights and complies with the Digital Millennium Copyright Act. We will promptly respond to proper DMCA takedown notices.
Designated Agent for Copyright Notices: Copyright infringement claims can be submitted to our designated agent at [email protected]. Valid DMCA notices must include identification of the copyrighted work, information sufficient to locate the infringing material on ScreenVox, the complainant's contact information, a statement of good faith belief that the use is not authorized, and a statement under penalty of perjury that the notice is accurate and the sender is authorized to act.
Repeat Infringer Policy: In accordance with the DMCA, ScreenVox will, in appropriate circumstances, disable or terminate the accounts of users who are repeat infringers.
Counter-Notice Process: Users may submit a counter-notice if they believe their content was removed in error. Counter-notices should be sent to the same designated agent address and must comply with DMCA requirements.
Good Faith Requirement: Abuse of the DMCA process through knowingly false claims may result in account termination or legal consequences.
ScreenVox is not affiliated with, sponsored by, or endorsed by the owners of any third-party content used as examples on our platform. All movie titles, characters, and trademarks mentioned (such as The Dark Knight, Night of the Living Dead, A Scanner Darkly, or others) are property of their respective owners, and are used on ScreenVox for the sole purpose of demonstrating the service's capabilities under fair use principles.
Any sample scripts or scenes are used for demonstration purposes only. ScreenVox's use of third-party names or content does not mean those parties endorse ScreenVox, nor does it imply any business relationship or partnership.
These Terms of Service constitute the entire agreement between ScreenVox and users, superseding all prior agreements. If any provision of these ToS is found unenforceable, the remaining provisions shall remain in effect. ScreenVox's failure to enforce any part of these ToS does not constitute a waiver.
